ARBI Exchange User Agreement

Welcome to ARBI Exchange! Before you begin, please read this document carefully. By using our services, you confirm that you have read, understood, and accepted these Terms. This is a legally binding agreement.

If you do not agree with any of these rules, please do not use our Services.

1. Key Concepts and General Rules

1.1. What is this agreement about?

This Agreement sets out the rules for using ARBI Exchange products, including the website https://arbi.exchange and the platform available through the Telegram Mini App (hereinafter referred to as the “Platform” or “Services”).

1.2. Key Terms

“User”, “You”: You — an individual using our Services.
“ARBI Exchange”, “We”: The company providing ARBI Exchange Services.
“Parties”: You and us together.
“Currency”: Fiat money (e.g., US dollars, euros) available for transactions on our Platform.
“Exchange”: A transaction involving the exchange of one Currency for another.

1.3. Availability and Updates

These Terms are public. The current version is always available at: https://arbi.exchange/documents/.

We may update these Terms at any time. By continuing to use the Services after an update, you agree to the new version.

2. Rules for Using the Services

2.1. Your Responsibility

By using the Platform, you agree to comply with these Terms and all applicable laws of your jurisdiction.

2.2. Exchange Rates

We offer two types of exchange rates:

Floating Rate: The rate may change slightly during the exchange due to market volatility.
Fixed Rate: You receive exactly the amount that was fixed at the beginning of the exchange.

2.3. Conditions for a Successful Exchange

We will complete your exchange if all of the following conditions are met:

You have sent us the Currency within the specified time period.
You have provided all necessary documents upon our request (see Section 3).
You have sent the exact amount specified in the request, including all fees.

If market conditions change sharply (for example, the exchange rate changes by more than 1%), we cannot guarantee an exchange at the fixed rate. In this case, we will offer you either to complete the exchange at the new market rate or to return your funds minus network fees.

2.4. Your Obligations and Representations

By accepting these Terms, you represent and warrant that:

You are at least 18 years old and have full legal capacity.
You are not located in a prohibited jurisdiction (see Section 10).
You use only legally obtained funds that belong to you.
You have not previously been blocked on our Platform.
You will not use the Services for any illegal activity (fraud, money laundering, etc.).
You will not attempt to hack, decompile, or harm the Platform.
You will not use a VPN, proxy, or other means to conceal your actual location.
You agree to receive all information from us electronically.

2.5. Platform Availability

The Platform operates 24/7, but we reserve the right to temporarily suspend its operation for technical maintenance without prior notice.

3. Identity Verification (AML/KYC)

3.1. Simplified Access

You do not need to create an account to use the Services. However, we use an automated risk management system to verify all transactions.

3.2. Your Consent to Verification

You agree to undergo AML/KYC (Anti-Money Laundering / Know Your Customer) verification if we request it.

As part of this procedure, we may ask you to provide identification documents, proof of the source of funds, and other documents.

3.3. Freezing and Refusal

If your transaction appears suspicious to us, we may freeze it while an investigation is conducted (for up to 30 days).

If you refuse to undergo verification, we have the right to refuse to process the exchange.

4. Privacy and Your Data

We process your personal data in accordance with our Privacy Policy.

By accepting these Terms, you consent to the processing and transfer of your data, including disclosure to law enforcement authorities upon their lawful request.

5. Exchange Rates, Fees, and Taxes

5.1. Rates and Fees

Information about exchange rates on the Platform may change rapidly. Our fee is already included in the exchange rate you see. There are no hidden charges.

5.2. Taxes

You are fully responsible for paying all taxes applicable to your exchange transactions.

We do not provide tax advice and are not responsible for your tax reporting.

6. Refunds and Risks

6.1. Finality of Transactions

All exchanges are final and non-refundable. You assume all market risks.

6.2. Refund Rules

Refunds are possible only in exceptional circumstances and at our discretion.
Refunds are made only to the details from which the funds were originally received.
To request a refund, contact our support service.

6.3. WARNING: PHISHING!

There are fraudulent websites that imitate ARBI Exchange. Always make sure that you are using the official domain: arbi.exchange.

We are not responsible for funds sent to fraudulent websites. If you have the slightest doubt, contact us through our official channels.

7. Indemnification

You agree to defend and indemnify ARBI Exchange against any third-party claims arising from your violation of these Terms or applicable law.

8. Disclaimer of Warranties

The Services are provided “AS IS” and “AS AVAILABLE.”

We do not guarantee that the Platform will operate without interruption, be error-free, or meet all of your expectations.

9. Limitation of Liability

Our total liability to you for any claims is limited to the amount of your exchange transaction and, under no circumstances, may exceed the equivalent of 500 EUR.

We are not liable for indirect damages, including lost profits.

10. Geographic Restrictions

Our Services are unavailable to citizens and residents of the United Kingdom, the United States, as well as countries subject to UN sanctions.

We may block your access and confiscate your funds if you violate this rule.

11. Prohibited Activities

When using the Platform, you are prohibited from:

Disrupting the operation of the Services.
Engaging in any illegal activity.
Using bots, scripts, or other automated means.
Distributing viruses or malware.

12. Termination of Access

We reserve the right to suspend or completely terminate your access to the Platform at any time without prior notice or explanation, particularly in the event that you violate these Terms.

13. Miscellaneous

Changes: We may modify or update our Services at any time.
Third-Party Links: We are not responsible for the content or security of websites that may be linked to from our Platform.
Copyright: All intellectual property belongs to ARBI Exchange. Use of our brand (for example, in contextual advertising) without permission is prohibited.
Assignment: We may transfer our rights and obligations under this Agreement to third parties. You may do so only with our written consent.
Entire Agreement: These Terms constitute the entire agreement between you and us.
